New Jersey litigation has specific rules for expert evidence, and an expert who does not meet them gets excluded. Under New Jersey Court Rule 4:10-2(d), a testifying expert's report must be disclosed in discovery, setting out the expert's opinions, the basis and reasoning for each, the facts and data considered, the expert's qualifications, and compensation. New Jersey also applies a modified Daubert standard for admitting expert testimony, meaning the methodology behind an opinion must be demonstrably reliable, not just the conclusion. A credible mold expert witness holds recognized qualifications, such as Certified Industrial Hygienist, Certified Safety Professional, or Council-certified Microbial Investigator and IICRC certifications, backed by real professional experience in industrial hygiene, environmental and occupational health, and building science. That combination is what lets an expert withstand a challenge to their qualifications.

Technically, the answer is yes. If a person is exposed to mold at work or while living in a rental property, they may be able to file for worker’s compensation or a settlement from the at-fault party.

How Do You Prove Mold Exposure?

To prove mold exposure, experts can test to see if humans have been harmfully exposed to:

  • Microbial volatile organic compounds

What Is the Difference Between a Mold Expert Witness and a Lay Witness?

A mold expert witness shares a testimony or opinion based on their knowledge and skill in the field. This allows them to draw highly specialized conclusions. Lay witnesses, on the other, may have personally witnessed the mold – but they don’t necessarily have the credentials to back their claims or stories up.

What Should I Do if My Property Does Test Positive for Mold?

First, we recommend redoing the test with a professional mold inspection team. Over-the-counter tests are not always accurate, nor do they give you important information on the extent of mold growth and what contributed to it.
