Deteriorated Lead Paint Creates Dust and Chips You Cannot See

Approximately three-quarters of homes built before 1978 contain lead-based paint. When painted surfaces peel, chip, or rub together, lead dust forms, and it is invisible. Lead exposure is particularly harmful to children and pregnant women, causing brain damage, slowed development, and learning problems.

We inspect painted building components, perform lead evaluation where required, and issue the certification essential for your compliance.

Visual Inspection for Lead-Based Paint Hazards

A certified lead evaluation contractor examines painted surfaces, window frames, door frames, and common areas for deteriorated paint conditions. Paint is considered deteriorated when it is peeling, chipping, chalking, or cracking; visible paint chips or surface dust signal a hazard requiring attention.

Dust Wipe Sampling

For dwellings in municipalities where at least three percent of children aged six or younger have elevated blood lead levels, the inspection must be carried out through dust wipe sampling. A representative surface is wiped and tested by a method approved by the United States Department of Housing and Urban Development.

Lead-Safe Certification

Where no lead-based paint hazards are found, we issue a valid lead-safe certificate. Following the September 2024 amendment, lead-safe certification is valid for three years, aligning with the three-year inspection cycle required of multiple rental dwellings and single-family rental units.

Lead-Free Certificates

A lead-free certificate is issued where testing confirms no lead-based paint is present. Unlike lead-safe certification, a lead-free certificate exempts the rental dwelling from future required inspections entirely, which is the better long-term outcome for a property owner.

Risk Assessment and Hazard Identification

Beyond the required inspection, a risk assessment identifies how lead dust is being generated and which painted surfaces drive human exposure. This is particularly important when a unit has repeatedly failed, or if a child in the dwelling has elevated blood lead levels.

Post-Remediation Clearance

After lead remediation work or lead abatement, clearance testing confirms the hazard is resolved. Interim controls temporarily reduce lead exposure risks, while lead abatement eliminates lead-based paint hazards permanently. We verify either before a unit returns to occupancy.

Preparation Guidance

Homeowners and landlords can prepare by cleaning surfaces and repairing paint deterioration ahead of the visit. We tell you which conditions commonly fail, so obvious problems are corrected before the inspection rather than found during it.

Visual Inspection or Dust Wipe Sampling

Our inspector examines all painted building components and common areas. Where your municipality requires dust wipe inspections, samples are collected from representative surfaces and sent for laboratory analysis rather than judged on sight.

Certification or Hazard Report

Where no hazards are found, you receive a lead-safe certificate. Where hazards are identified, the report specifies each location and condition, and lead remediation must start within 30 days of the violation notice.

Reinspection After Remediation

Following interim controls, reinspection is required within 60 days to confirm the hazard is resolved. Lead abatement carries its own clearance requirements. We verify either and issue certification once the unit passes.

Who Needs a Lead-Based Paint Inspection in New Jersey?

Owners of single-family, two-family, and multiple rental dwellings constructed prior to 1978. Federal law also mandates disclosure of lead-based paint information for homes built before 1978 during a sale. Owner-occupied properties are not covered by the rental inspection requirement.

How Often Are Inspections Required?

Every three years, or upon tenant turnover, whichever comes first. An inspection at turnover is not required where a valid lead-safe certificate is in place. An inspection at turnover resets the clock on the three-year cycle.

How Long Is a Lead-Safe Certificate Valid?

Three years from issuance, following the September 2024 amendment to P.L. 2021, c. 182. The earlier two-year term is still cited in older guidance, so confirm the date on your certificate rather than assuming which rule applied when it was issued.

What Happens If I Do Not Comply?

Property owners face penalties for outstanding lead violations and have 30 days to cure after notification. Municipalities that fail to enforce the requirement can be fined as well, which is why enforcement has tightened.

What Is the Difference Between Lead-Safe and Lead-Free?

A lead-safe certificate means no lead-based paint hazards were found at the time of inspection, and it expires. A lead-free certificate means no lead-based paint is present at all, and it exempts the dwelling from periodic inspections permanently.

Will My Inspection Be Visual or Dust Wipe?

That depends on your municipality. Where fewer than three percent of children tested have blood lead levels at or above five micrograms per deciliter, visual inspection is permitted. At three percent or above, dust wipe sampling is required.

Which Rental Dwellings Are Exempt?

Units constructed during or after 1978. Seasonal rentals of less than six months per year without consecutive lease renewals. Dwellings certified lead-free pursuant to N.J.A.C. 5:17. Multiple dwellings registered with the Department for at least ten years with no outstanding lead violations and a recent cyclical inspection performed.

What Happens If Lead Hazards Are Found?

Remediation must begin within 30 days. Interim controls temporarily reduce lead exposure and require reinspection within 60 days. Lead abatement removes the hazard permanently. Either path ends with verification before the rental unit is considered compliant again.
