New Jersey applies a modified Daubert standard under In re Accutane Litigation, so the methodology behind an opinion is what gets tested, not the conclusion alone. An expert whose report misses Rule 4:10-2(d) or whose methods do not hold up gets excluded, taking the technical case down with them.

Our Mold Expert Witness Services

We handle the technical side of a mold case from the first site visit through trial testimony, for plaintiff or defense, in personal injury, property damage, construction defect, and insurance claim matters.

Mold Inspection and Sampling

We inspect the property, map moisture with meters and thermal imaging, and collect air and surface samples. Laboratory analysis identifies mold species and quantifies mold spores, producing the evidentiary record the rest of the opinion rests on.

Causation and Source Analysis

We trace mold growth back to its origin, whether a construction defect, a maintenance failure, or a water intrusion event, and connect that source to the property damage or personal injury the claim alleges. Causation is where mold cases turn.

Remediation Evaluation

We assess whether prior mold remediation followed accepted industry standards and whether it worked. That includes reviewing the remediation contractor's protocol, containment, and clearance documentation, and confirming whether the moisture source was corrected before the work was signed off as complete.

Rule 4:10-2(d) Expert Reports

We prepare written reports setting out each opinion, the basis and reasoning behind it, the facts and data considered, our qualifications, and compensation. That is what New Jersey discovery requires, and reports that skip elements invite a motion to exclude.

Deposition and Trial Testimony

We testify at deposition and at trial, translating mold contamination, exposure pathways, and health effects into language a jury follows. A finding that a scientist understands is worth nothing in a courtroom if a juror cannot follow it.

What Credentials Should a Mold Expert Witness Have?

Mold experts use moisture meters to detect water intrusion, infrared thermal imaging to identify hidden mold sources behind finished surfaces, and air and surface sampling for mold assessment. Laboratory analysis is essential for accurate mold identification, since species and spore counts cannot be determined visually.

What Does a Mold Inspection Cover in a Legal Case?

A mold inspection assesses residential and commercial areas for mold presence, evaluates the moisture sources contributing to mold growth, and identifies underlying issues such as water intrusion or drainage failure. In litigation it also documents the extent of mold damage, which is what property damage and insurance claims turn on.

How Do You Prove Mold Contamination Reached a Level That Creates Liability?

By showing the indoor condition departed from normal fungal ecology. That means comparing indoor spore counts to outdoor controls, identifying mold species associated with water-damaged buildings, documenting the extent of mold infestations, and tying the elevated condition to a specific water event or maintenance failure.

Can a Mold Expert Witness Work for Either Side?
